Description
Appellant was convicted of the offense of murder. V.T.C.A., Penal Code, Sec. 19.01. The jury assessed punishment at forty years confinement in the Texas Department of Corrections. The Houston Court of Appeals affirmed the conviction, concluding it was not error to admit a videotape of the murder scene. Gordon v. State, 735 S.W.2d 510 (Tex.App. - Houston [1st Dist.] 1987). We granted appellants petition for discretionary review to determine whether admissibility of a videotape, including close-up footage of the victim, should be governed by the still photo admissibility standard set out in Martin v. State, 475 S.W.2d 265 (Tex.Cr.App. 1972), and Thomas v. State, 701 S.W.2d 653 (Tex.Cr.App. 1985).
